Fellow County men, women and children of Nyeri County, on the 28th of January, 2014 it came to my attention after the release of form 1 places selection that children in Nyeri County were greatly disadvantaged and disenfranchised by the method used to select students to national schools and extra county schools. The policy for selection in the extra county schools reserves 20% of the admission places to students in the constituency (sub-county) that the school is located, 40% to county students and 40% to the rest of the nation.
In Nyeri County a total 19,002 students sat for K.C.P.E. 467 were selected to join national schools, 637 joined extra county schools outside Nyeri while 1570 from other counties were admitted into Nyeri extra county schools, in this category of schools Nyeri lost out 932 places. In the category of county schools which are reserved for county students a total of 1692 students from other counties were admitted. In the category of sub-county schools which are supposedly reserved for constituency (sub-county) over 9500 outside the county were admitted. On the basis of this information on the 29th January I wrote and delivered the letter to the Cabinet Secretary of Education, Science and Technology categorically informing him that the above scenario was unacceptable. Quoting Chapter 7 Part 1 Section 74 of the Constitution of Kenya and the County Government Act Part v Section 30 (3) we have given the Cabinet Secretary a deadline to reverse this untenable situation so as to guarantee Nyeri County residents and their children access to their rightful share of the education resource and development as per the Constitution of Kenya and the County Government Act.
It is expected that the remedial action will be forthcoming before the students report to school by the 5th of February, 2014. In the meantime the County Government has instructed its legal team to be in a state of high preparedness to launch legal action in the High Court should the response not be forthcoming. It is my desire in the spirit of consultations and negotiations as espoused in our country’s constitution that the County will not be forced to seek judicial intervention. However I will not shy away from defending the rights of Nyeri County residents as your Governor. Besides this scenario I am beginning consultations with the National Government to construct two new County Schools (centres of excellence) to mitigate the reduction in number of spaces available to county children in the future after the conversion of Kagumo High School and Bishop Gatimu Ngandu Girls to National School Status.
